These terms and conditions refer to the use of the website www.homeandliving.co.uk by users and their relationship with our brand.
The website www.homeandliving.pt is owned and operated by Abraços Épicos, Lda, a company with tax identification number 516113429, with registered office at Avenida Pedro Álvares Cabral, 231, Armazém Nº4 2710-297 Linhó - Sintra, Portugal – hereinafter Home & Living, with contact email contabilidade@homeandliving.pt.
I. General
1.1. General Terms of Use
Please read these terms and conditions of use carefully, as they govern your access to and use of this website. Anyone accessing the Home & Living website and/or its subsidiaries (hereinafter referred to as “Home & Living”) implicitly accepts the terms and conditions contained in these General Terms of Use. If you do not agree with the following terms, we recommend that you report the situation to the Home & Living email address: contabilidade@homeandliving.pt and that you do not use this website. This website contains graphics, photographs, images, sample documents, artwork, text, fonts, music, software tools and other types of information (hereinafter referred to as “content”) that are the property of Home & Living.
Home & Living may change or modify the website, including services and content, at any time and without prior notice. To ensure greater awareness of your rights and responsibilities as a User, we recommend that you consult these terms and conditions of use each time you access this website.
Home & Living cannot guarantee that:
- Creations are always unique and that they are not similar to and/or used by others;
- Any design created using our creation tools does not infringe any third-party rights and/or any registered trademark.
The User assumes responsibility for the use of this website in accordance with the rules present in these terms and conditions and in accordance with the legislation in force in Portugal, especially with regard to the rules of e-commerce. You agree that you will not use this website to produce offensive, illegal, malicious, harmful products or material, or any other action that violates the rights of other individuals, trademarks, or companies.
Home & Living informs the user that by accepting these terms and conditions, they also accept the terms and conditions of other countries in which Home & Living operates within the European Economic Area. Furthermore, Home & Living informs that the content of the terms and conditions of all websites in countries within the European Economic Area, including this one, is entirely identical, differing only in the language in which they are presented. However, in case of discrepancies between the terms and conditions of the different countries in which it operates, Home & Living states that the Portuguese version shall prevail.
1.2. User Conduct
By using this Home & Living website, you agree to:
1. Register on the website, creating a unique profile in your own name or representing a legal entity, provided you have the power to do so, providing truthful information and refraining from creating multiple profiles or profiles on behalf of third parties without sufficient powers of representation;
2. Not upload, download, publish, email or otherwise transmit content:
2.1. that is illegal, pornographic, hate-inciting, violates laws related to child pornography and sexual exploitation of minors, allows or encourages unsafe practices that may cause physical, mental or moral harm to children, is objectionable in racial, ethnic, social, political, legal, moral or religious terms, or otherwise objectionable, or infringes on the rights of third parties, including, without limitation, the rights to privacy and intellectual property protection;
2.2. that may violate any patent, trademark, trade secret, copyright, or intellectual property right or exclusive right of any person. For the avoidance of doubt, the User may only contribute works of their own authorship, therefore original works. This means that the User may not use images of celebrities or company products, nor images, texts, or graphic designs that have been copied from a particular website without the written authorization of its owner. The User may not create a "new" image or slogan using elements of images or quotes that were created by other people;
2.3. that constitutes or encourages a criminal offense or illegal activity, violates the rights of any person, or violates any national or international law or regulation;
2.4. involving the transmission of unsolicited or unauthorized advertising or promotional materials, unsolicited mail, spam, chain letters, or any other form of solicitation;
2.5. whose information is false or likely to mislead;
2.6. or any material containing computer viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any software, hardware, or telecommunications equipment;
3. Do not impersonate any individual or entity, or misrepresent or deliberately misrepresent the User's relationship with an individual or entity;
4. Do not disrupt or misuse the website or any services, promotions or discounts, system resources, accounts, servers or networks, or other websites linked to or accessible through our website, or compromise their security;
5. Do not use or falsify or access non-public areas of the site. Any User who improperly and without authorization accesses these areas of the website may be subject to legal action;
6. Do not transfer the User's Home & Living account to another person without the prior written consent of Home & Living;
7. Do not copy, alter, or distribute rights or content of the site, services, or tools, or the trademarks and copyrights of Home & Living;
8. Home & Living reserves the right not to capture or otherwise collect information about Users, including their email addresses, without their consent.
Home & Living reserves the right to cancel any user accounts created without this constituting an obligation for Home & Living to indemnify the user, in the event of the creation of false or abusive profiles regarding representation rights, or in the event of abusive use of the website or promotional campaigns in effect at any given time.
The User acknowledges that Home & Living does not perform any prior review of submitted content. Upon placing an order, the User acknowledges that Home & Living may review the order and its content to ensure compliance with Home & Living's guidelines and the terms and conditions of this agreement. Home & Living does not sign and, consequently, is not responsible for any content submitted to the site by any User, or any opinion, recommendation, or advice expressed therein. Without limiting the foregoing, Home & Living Home & Living and its designated representatives shall have the right to refuse or remove, without prior notice, any content that violates the contract or that Home & Living considers otherwise objectionable. In this regard, the Home & Living User agrees to review and bear all risks associated with the use of all their content.
The User acknowledges being responsible for all acts and communications carried out through their account. Home & Living assumes no responsibility and cannot be held liable for content uploaded or otherwise transmitted by or to the User or to third parties. This translates into the impossibility of Home & Living... Living assumes no responsibility or liability for errors, defamation, insults, slander, omissions, falsehoods, counterfeits, obscenities, pornography, or blasphemies that the User or third parties may encounter. The User agrees to waive all claims against Home & Living, service providers, agents, and employees for losses, damages, and injuries related to communications, content, or materials contained on the website. The User also agrees to indemnify Home & Living for all claims and expenses, including reasonable attorneys' fees, arising from or related to the User's breach of any provisions of this agreement.
1.2.1. Limited Use of Copyrighted Materials
It is important to emphasize that the client is solely responsible for the content they submit, the content they create in the product editor available on the Home & Living website, and the content they request to be used in the "design replication" and "custom design" services. That is, the client secures the rights to images, graphics, fonts, text, and other materials incorporated into the products. By submitting a design, using the product editor available on the Home & Living website, or requesting "design replication" or "custom design" services, the client agrees not to include text, fonts, images, drawings, trademarks, service marks, or any other copyrighted materials of third parties in the products, unless they have obtained the necessary authorizations from the owners. The client guarantees that the products do not infringe any third-party rights, including copyrights, trademarks, publicity rights, or privacy rights, and that they will not defame any third parties. You also warrant that you possess all necessary rights or authorizations to incorporate third-party materials into your products, including third-party materials made available through a third-party design service. The customer warrants that they possess all necessary authorizations, permissions, and rights to place an order through this website and authorizes Home & Living to produce the products on their behalf. The customer grants Home & Living the right to copy, modify, create derivative works, and vectorize any content submitted by the customer for the purpose of fulfilling the order. Furthermore, the customer warrants that they have sufficient rights to permit Home & Living to copy, modify, create derivative works, and vectorize any uploaded content for the purpose of fulfilling the order.
1.3. Exclusive Rights
The User acknowledges and accepts that all content contained or distributed on or through the website by Home & Living, its advertisers, or other third parties is protected by trademarks, service marks, patents, copyrights, or other exclusive rights and laws. The User may not use or distribute any content received through the website without the authorization of Home & Living or the content owner.
The User acknowledges and accepts that the website and any software made available to or used in connection with the website contain proprietary and confidential information that is protected by intellectual property and other laws.
Subject to the User's compliance with the terms and conditions of this agreement, Home & Living grants the User a non-exclusive and non-transferable license to use the software only as necessary to use this website, and relies on the User's commitment not to modify, rent, lease, lend, sell, distribute, or create derivative works based on the website or the software, in whole or in part.
Home & Home & Living grants the User a non-exclusive, revocable, and limited license to use Home & Living's content, tools, product images, and photographs to promote and publicize the website. To do so, the User must always include proper attribution to the author of the content and a link to the Home & Living website. Home & Living reserves the right to terminate this license at any time.
1.4. Copyright Policy
Home & Living's distinctive signs, product images, and trademarks may not be used in connection with any product or service not belonging to Home & Living, in any way that is likely to cause confusion among customers, or in any way that denigrates or harms the reputation of Home & Living. All other trademarks not belonging to Home & Living that appear on this website are the property of their respective owners, who may or may not be affiliated with Home & Living, be related to Home & Living, or be sponsored by Home & Living.
This website and all its content are owned by Home & Living, which holds the respective copyrights, or are owned by parties who have granted Home & Living a license to use said property.
It is expressly prohibited to retain, copy, distribute, disclose or use the content, except in those cases stipulated in these terms and conditions of use. Home & Living reserves the right to add, delete or modify part(s) of the content at any time and without prior notice.
1.4.1. Intellectual Property Policy
The Intellectual Property defended by Home & Living emerges when a particular idea becomes something tangible. Intellectual property can be a trademark, a patent, an industrial design, or another type of creation and can be legally acquired. Home & Living respects the intellectual property rights of others. Home & Living may terminate the accounts of Users who violate, or may violate, the copyrights or other intellectual property rights of others.
If a User believes that their content has been copied in a way that constitutes a violation of copyright and/or trademark, they are requested to notify Home & Living and provide the following information (“Notification”):
An electronic or handwritten signature of the person authorized to act on behalf of the copyright/trademark owner;
A description of the copyrighted and/or trademarked work that has allegedly been infringed;
The User's address, telephone number, and email address;
A statement from the User affirming that, in their good faith opinion, the disputed use was not authorized by the copyright/trademark owner, its agent, or the law;
A statement from the User, issued under penalty of perjury, affirming that the aforementioned information included in their Notification is accurate and that the User is authorized to act on behalf of the copyright/trademark owner in question.
Furthermore, and adapting to our Print on Demand (POD) service, it is Home & Living's policy to terminate the privileges of any User who repeatedly infringes copyright, through immediate notification of this infringement to Home & Living by the copyright holder or a legal representative. Notwithstanding the foregoing, if the User believes that their work has been copied and published on the services or used in a book in a way that constitutes copyright infringement, they must provide the information set forth in our intellectual property policy to Home & Living.
Please note that this procedure is intended solely to notify Home & Living of any copyright or trademark infringement by the User. Therefore, you can contact us at: contabilidade@homeandliving.pt.
II. Home & Living Guarantees
2.1. Termination of Contract with Home & Living
The User agrees that Home & Living may, at its sole discretion, terminate this contract, including, without limitation, canceling their password, their account (or any part thereof) or their use of the site, and remove and delete any content the User has contributed to the site, at any time, with or without cause.
Home & Living may also, at its sole discretion and at any time, cease making the site, or any part thereof, available, with or without prior notice. The User agrees that any cancellation of their access to the site under any provision of this Agreement may be made without prior notice, and acknowledges and agrees that Home & Living may, with immediate effect, deactivate or delete their account and all related files and information found in their account and/or prevent any further access to such files from the site.
In addition, the User agrees that Home & Living will not be liable to the User or any third party for any cancellation of the User's access to the website. If the User objects to any terms and conditions of the contract, or is otherwise dissatisfied with the website, their only recourse is to immediately cease using the website and/or cancel their account. To do so, the user must send an email with such a request to the email address: contabilidade@homeandliving.br.
The termination of this contract does not affect the respective rights and obligations of the parties (including, without limitation, payment obligations) that arise prior to the termination date.
2.2. Indemnification
The User agrees to defend, indemnify, and hold Home & Living harmless from all judgments, losses, liabilities, costs, and expenses, including, without limitation, reasonable attorneys' and experts' fees and litigation expenses arising out of, or based upon:
- The content that the User submits, posts, or transmits through the website;
- The User's use of the website;
- The User's connection to the website;
- The User's breach of contract;
- The User's violation of third-party rights.
2.3. Disclaimer of Warranty
The User's risk of using this website rests solely with the User. This website and the information, services, products, programs, and materials available through it are provided "as is" and "as available."
The website and all its content are provided without warranties of any kind, whether express or implied, including, but not limited to, warranties of merchantability and fitness for private use or any infringement of rights. This includes, but is not limited to:
All warranties of title, or implied warranties of merchantability, fitness for a particular purpose, and non-infringement of intellectual property rights;
Casa & Living makes no warranties:
- That the website or its content will meet the User's needs;
- That the website or service will be uninterrupted, timely, secure, or error-free;
- That the quality of products, services, information, or other materials purchased or obtained by the User through the website will meet the User's expectations;
- That any defects, if any, will be corrected;
- Regarding unauthorized access to or use of our secure servers and/or personal and/or financial information stored therein;
- Regarding any bugs, viruses, or similar issues that may be transmitted to or through our services by any third party;
- There is a possibility that references and links to products or services of independent companies may appear on the website. These references and links are provided without warranties of any kind, whether express or implied.
The User agrees that Home & Living will not be liable for any damages incurred by the User in connection with the website or any content on the website. The User expressly agrees that the risk of using this website, including all content, data, or software distributed by the website or downloaded or accessed from or through it, rests solely with the User. The User understands and agrees that they will assume full responsibility for all damages caused.
2.4. Limitation of Liability
Neither Home & Living nor its officers, employees, directors, agents, suppliers, or any other party involved in the creation, production, transmission, or distribution of Home & Living services or related services shall, under no circumstances, including, without limitation, in the case of its own negligence, be liable for any loss or compensation for damages of a direct or indirect nature, including, without limitation, compensation for loss of profits, goodwill, use, data, or other intangible losses (even if Home & Living has been advised of the possibility of such indemnification obligations), arising from:
- The use or inability to use the website;
- The cost of acquiring replacement goods and services for any goods, data, information, or services purchased or obtained, or messages received, or transactions entered into through or from the website;
- Unauthorized access to or alteration of User transmissions or data;
- Regarding statements or conduct of third parties on the site, or,
- Regarding any other matter related to the site.
The User expressly acknowledges that Home & Living will not be responsible for defamatory, offensive, or illegal content or conduct of any third party, and that the risk of injury or damage resulting therefrom rests exclusively with the User.
2.5. Promotional Campaigns
Once a purchase is finalized, products cannot be modified, nor can the order be canceled. The customer must ensure that they have correctly selected the voucher for their purchase, and is responsible for any errors if the voucher activation is not performed correctly.
In case of a complaint and the need for a refund, the company reserves the right to deduct or remove the discounts applied by the campaign.
Promotional campaigns are not cumulative, meaning that the discounts and promotions of one campaign cannot be combined with others. Abusive use of the website to obtain undue financial advantages, such as promotions or discounts, constitutes fraud and may result in the cancellation of the user's account, annulment of illegitimate benefits obtained, and legal action, both civil and criminal, to claim compensation for material and moral damages.
Promotional offers are valid only while displayed on the website. Home & Living reserves the right to cancel or suspend promotional campaigns without prior notice to the customer.
2.5.1. Free Shipping Offer Campaign
The Free Shipping Offer works under the conditions presented on the website, usually taking into account the value of the order placed, and is applied at checkout, provided the requirements are met and it is valid.
This campaign may or may not be combined with other campaigns. If it is combined, this campaign will only apply to the net amount actually paid by the customer.
Home & Living reserves the right to change the conditions of this campaign at any time and without prior notice.
III. Terms of Sale - Shipping and Return Policy
3.1. Order Cancellation
Once a purchase process is finalized, the products cannot be modified nor can the order be cancelled. The right of withdrawal, which allows consumers to cancel distance selling contracts within 14 days of receiving the products without the need for justification or additional costs, does not apply to goods made to measure or clearly personalized according to the customer's specifications.
For personalized products, the right of withdrawal cannot be exercised. However, for products without any personalization, it is possible to request cancellation or return within 14 days of receiving the order.
Customers wishing to exercise this right in relation to non-personalized products should go to the "Support Service" page on the website, providing the following information: name, address, telephone number, email address, order number and a list of the products they wish to return.
After receiving the request, we will contact you to verify if the right of withdrawal applies to the specific case and the products in question. Instructions on the return process will also be provided. The choice of shipping method and carrier will be the customer's responsibility, who assumes the risks associated with the return.
The refund will be made within a maximum of 30 days after receiving the returned products in perfect condition and in their original packaging. The refunded amount will correspond to the amount paid for the returned products, excluding initial delivery costs and return charges.
3.2. Returns
Home & Living is committed to producing orders according to the specifications provided by the customer.
Please note that we cannot be held responsible for:
- Spelling, punctuation, or grammar errors made by the customer;
- Poor quality or low resolution of uploaded images;
- Design errors made by the customer during the product creation process;
- Incorrect choice of options, such as: finish, quantity or type of product, color;
- Defects in products caused by the customer after receiving them;
- Incorrect address provided by the customer.
We recommend that you carefully review your designs and correct any possible errors before placing your order.
Returns or refunds will only be considered in proven cases of product defects or damage. For the analysis to be carried out, the customer must report the problem via email to encomendas@homeandliving.com within a maximum of fourteen (14) days after receiving the product. The request must include:
- Photographs or video clearly showing the identified problem on the entire product;
- Photographs of the shipping box, where the carrier's label is visible;
- In the case of size discrepancies, a photograph with a ruler positioned next to the print or product for reference;
- Indication of the quantity or percentage of damaged products.
The company reserves the right, in case of reprinting or refund, to act exclusively on products demonstrably affected by defects or damage, therefore the resolution will only be possible after receiving and analyzing the damaged product. The return of the product is exclusively the responsibility of the customer, and the product must be returned to the address that will be provided in response to the email sent reporting the situation.
Refunds, when applicable, will be processed within a maximum of 30 days after confirmation of the problem.
If the product was purchased under promotional conditions, the return or refund policy may be different; it is necessary to consult the specific terms and conditions of the current campaign.
It is important to note that ordered products are personalized and manufactured exclusively for the customer, which makes return conditions more restrictive and limits the possibility of exchanges or refunds.
3.3. Prices
Product prices are described on the website and are in Euros. Prices and products may change at Home & Living's discretion. Home & Living may occasionally offer promotional discounts. The User must accept the terms of the promotion to benefit from the discount. The User agrees not to use more than one discount per item, unless expressly permitted by Home & Living.
3.4. Shipping
Ownership and risk of loss of all products ordered by the User are transferred to the Carrier upon shipment and are transferred to the User when they sign the receipt confirming receipt of the ordered products. Purchases are subject to Home & Living's shipping and return policy. Home & Living reserves the right to cancel any product order for any reason, including orders that may infringe the intellectual property rights of third parties, by notifying the buyer of the order cancellation.
Order shipping times vary from 1 to 3 business days, and this timeframe may be delayed during periods of higher order volume. Delivery times vary from country to country:
Mainland Portugal: 1 to 2 business days;
Azores and Madeira: 5 to 9 business days;
Mainland Spain: 1 to 2 business days;
Balearic and Canary Islands: 6 to 10 business days;
Other European countries: 2 to 8 business days.
Please note that the delivery time count only begins after payment has been validated and confirmed, and will only start being counted from 3 PM on each business day.
Order shipping times may be extended and altered depending on the volume and quantity of orders.
Delivery is considered complete on the date the carrier registers receipt of the order by the customer.
3.5. Shipping Costs
Shipping costs are the responsibility of the customer, and the cost is automatically calculated for each order during the checkout process, based on the products ordered and the destination region, according to a pre-established table.
3.6. Payment
Payments can be made via PayPal, MB, MBWAY, Credit Card, Google Pay, and Apple Pay. Payment will be transferred to Home & Living on the order date and is subject to subsequent validation.
The final price of any product will be the price shown on the date and time of the order. The User ensures that all details provided at the time of the order are correct and valid. The User guarantees that the credit/debit card has sufficient funds to cover the order costs.
Home & Living reserves the right to obtain validation of the User's credit/debit card before processing any order.
The contract is only complete when the amounts are received and confirmed by Home & Living.
Casa & Living guarantees that the entire payment process is carried out with complete security.
3.7. Correction of Errors and Inaccuracies
The information and product lists appearing on this website may contain typographical errors or be inaccurate, and may not be complete or up-to-date. Therefore, Home & Living reserves the right to correct all errors, inaccuracies or omissions, and to change or update information at any time without prior notice (including after the User has placed their order). Note that such errors, inaccuracies or omissions may relate to the description, prices and/or availability of products. Home & Living also reserves the right to limit or restrict product quantities (even after the User has submitted their order) for any reason, including, without limitation, if the product violates any terms of this agreement.
If a product is offered for sale with an incorrect price or incorrect information due to a typographical error, an error in pricing or product information that Home & Living receives from partners, Home & Living will be responsible for the consequences of the error. Home & Living reserves the right to refuse or cancel orders for products listed with incorrect prices.
Home & Living has the right to refuse or cancel these orders regardless of whether they have already been confirmed and the sale has been charged to the Customer. If the purchase has already been charged and the order is canceled, Home & Living will immediately issue a credit to the Customer's credit card account or refund the amount in the same way the purchase was made. If Home & Living has overcharged for any product, it will refund the User for the difference between the amount charged and the correct price of the product in question.
3.8. Invoicing
The invoice is sent to the customer via their email account once payment is made and confirmed.
IV. Applicable Law
The seller of the products and services offered and sold on this website is Abraços Épicos, Lda., a company duly established under the laws currently in force in Portugal, whose registered office is located at Avenida Pedro Álvares Cabral, 231, Armazém Nº4 2710-297 Linhó - Sintra, Portugal.
All matters relating to the protection, infringement or unlawful use of copyrighted materials shall be dealt with and resolved under the copyright laws of Portugal. All other matters relating to your access to or use of this website shall be dealt with and resolved under the laws of Portugal. Any legal action or proceeding relating to or arising from your access to or use of this website shall be brought in Portugal. As a User of the website, you agree to submit to the jurisdiction of the courts of Portugal; and agree that jurisdiction is appropriate in such legal action or proceeding. You further agree not to claim, in any legal action or proceeding involving Home & Living, that a court in Portugal may be an inappropriate forum for carrying out such legal action or proceeding.
